1. Obligations of the Carrier
– Ensure complete and safe transportation of the property to the designated location within the specified timeframe.
– Deliver the property to the authorized recipient.
– Bear all expenses related to the transportation of the property, unless otherwise agreed.
– Purchase civil liability insurance in accordance with the provisions of law.
– Compensate the charterer for damages in the event that the carrier loses or damages the property, unless otherwise agreed or otherwise provided by law.
2. Rights of the Carrier
– Verify the authenticity of the property, the bill of lading, or other equivalent transport documents.
– Refuse to transport property that does not match the type of property agreed upon in the contract.
– Require the charterer to pay the full freight charges on time.
– Refuse to transport property prohibited from transaction, or property of a dangerous or toxic nature, if the carrier [deems it unsafe/discovers it].
3. Obligations of the Charterer
– Pay the full freight charges to the carrier within the agreed timeframe and method.
– Provide necessary information related to the transported property to ensure the safety of the transported property.
– Oversee the property during transit, if agreed upon. In the event that the charterer oversees the property and it is lost or damaged, no compensation shall be granted.
Rights of the Charterer
– Require the carrier to transport the property to the exact location and time agreed upon.
– Directly receive or designate a third party to receive the transported property.
4. Liability for Compensation of Damages
– The carrier must compensate the charterer for damages if the property is lost or damaged.
– The charterer must compensate the carrier and third parties for damages caused by transported property of a dangerous or toxic nature that lacks proper packaging or safety measures during transit.
– In the event of force majeure leading to the loss, damage, or destruction of the property during transit, the carrier shall not be liable for compensation of damages, unless otherwise agreed or otherwise provided by law.
